1. Scope of Services
Elmech Services JA provides electrical and mechanical engineering services which may include equipment inspection, testing, certification, compliance reminders, invoicing, and access to client records through our portal.
2. Client Responsibilities
- Provide accurate and complete information
- Ensure equipment is safe and accessible for inspection and servicing
- Maintain compliance with applicable regulations and standards
- Use the portal responsibly and keep credentials confidential
Elmech is not responsible for delays caused by incomplete or inaccurate information, or site/access constraints outside of our control.
3. Certificates & Compliance
- Certificates are issued based on inspections conducted at the time of service.
- Certification does not guarantee future performance or safety beyond the inspection date.
- Ongoing equipment maintenance and compliance remain the client’s responsibility.
4. Portal Access & Security
- Access credentials must not be shared or reused insecurely.
- You are responsible for activity under your account.
- Elmech may suspend access if misuse, suspected compromise, or security risk is detected.
5. Payments & Invoicing
- Invoices are payable according to agreed terms.
- Late payments may result in suspension of services or reminders.
- Disputes must be raised promptly and in writing.
6. Reminders & Notifications
Reminders and notifications are provided as a support tool and do not replace client responsibility for compliance, renewals, and scheduling. Elmech is not liable for missed inspections or expiries due to communication failures outside our reasonable control (e.g., carrier outages, incorrect contact details).
7. Intellectual Property
Website content, reports, certificate templates, and portal software are the property of Elmech Services JA (or its licensors), unless otherwise stated. Unauthorized copying, distribution, or modification is prohibited.
8. Limitation of Liability
To the fullest extent permitted by law, Elmech is not liable for indirect, incidental, or consequential damages. Any liability is limited to the value of the service provided for the claim giving rise to liability. The portal is provided “as is” and may be updated, interrupted, or changed over time.
9. Termination
Elmech may suspend or terminate access for misuse, breach of these terms, non-payment, or security concerns. We may update or discontinue features with reasonable notice where feasible.
10. Governing Law
These Terms & Conditions are governed by the laws of Jamaica.
